TERMS AND CONDITIONS

1. Acceptance of These Terms
1.1. These Terms and Conditions ("Terms") govern every booking, session, purchase, and interaction with Iris Photography NZ ("we", "us", "our", "the Company"), whether at a pop-up event, studio, or private booking.
1.2. By booking a session, making a payment, or participating in a photography session with us, you ("the Client", "you", "your") confirm that you have read, understood, and agree to be bound by these Terms in full.
1.3. If you are booking or checking in on behalf of a group, family, or another person (including a minor), you confirm that you have the authority to accept these Terms on their behalf, and that you have informed them of these Terms.
1.4. If you do not agree to these Terms, please do not proceed with booking, payment, or participation in a session.
2. Definitions
2.1. "Session" means the photography appointment during which your iris (and, where applicable, additional imagery) is captured.
2.2. "Final Image(s)" means the edited digital photograph(s) of your iris produced from the Session, including any printed or framed reproductions.
2.3. "Raw Image(s)" means the unedited photograph(s) captured during the Session, prior to any digital adjustment.
2.4. "Pop-Up Event" means a temporary, mobile installation of our photography service at a public or private venue.
2.5. "Website" means irisphotographynz.com and any associated booking, payment, or ordering platforms we operate.
3. Bookings, Pop-Ups & The Session Process
3.1. Bookings may be made online, in person at a Pop-Up Event, or by other means we make available from time to time. A booking is only confirmed once payment (or an agreed deposit) has been received, where payment is required prior to the Session.
3.2. Pop-Up Event dates, times, and locations are published in good faith but may change or be cancelled due to venue availability, weather, low demand, or circumstances beyond our control (see clause 20, Force Majeure). We will make reasonable efforts to notify affected clients of any change or cancellation.
3.3. Each Session typically takes approximately two minutes of active capture time, though total time at the venue (including consultation and image selection) may be longer.
3.4. You agree to arrive on time for your booked Session. Late arrival may result in a shortened Session, rescheduling subject to availability, or forfeiture of the booking at our discretion, in each case to be handled reasonably and consistently with clause 15 (Cancellations & Refunds).
3.5. We reserve the right to refuse or discontinue a Session if a Client behaves in a manner that is abusive, unsafe, or that puts our staff, equipment, or other clients at risk. In such cases, clause 15 (Cancellations & Refunds) applies.
4. Payment
4.1. Prices are as displayed on the Website or at the Pop-Up Event at the time of booking, and are in New Zealand dollars (NZD) inclusive of GST unless stated otherwise.
4.2. Full payment is generally required at the time of booking or immediately following the Session, before Final Images are supplied, unless otherwise agreed in writing.
4.3. We accept payment via the methods displayed at the point of sale. We are not responsible for delays, declines, or errors caused by your bank, card issuer, or payment provider.
4.4. Prices may change at any time, but any change will not affect a booking for which payment has already been accepted.
5. Flash Photography & Health Disclosure
5.1. Our iris photography process uses a controlled flash of light to capture fine detail. This is a standard and necessary part of the process.
5.2. Before your Session begins, you must inform our staff if you or anyone in your group has photosensitive epilepsy, migraines triggered by light, light sensitivity, or any other condition that may be affected by bright flashes. Our staff will ask about this at check-in, and it is your responsibility to disclose it, whether asked or not.
5.3. If you disclose such a condition, we will work with you to determine whether an adjusted process is possible, or whether it is not appropriate for you to proceed. Where you choose to proceed after disclosure and after being advised of the risk, you accept that risk.
5.4. Except where caused by our negligence, we are not liable for discomfort or adverse reactions resulting from the use of flash where a relevant condition was not disclosed to us before the Session.
6. Image Capture, Editing & Natural Variation
6.1. All Final Images undergo minor digital adjustment (colour correction, clarity enhancement, reflection reduction) intended to present the true detail and colour of your iris as accurately as possible.
6.2. Due to lighting conditions at the time of capture, individual eye characteristics, screen calibration, and print/framing materials, the Final Image may appear slightly different from how your eye appears in person, on a phone screen, or once printed or framed. This is a natural and expected result of the photographic and printing process, not a defect.
6.3. Frame, mount, and product mock-ups shown on our Website or marketing materials are indicative only and are not to exact scale.
7. Personalisation & Custom Text
7.1. Where a product includes customer-supplied text (such as names, dates, or captions), you are responsible for checking spelling, dates, and accuracy before submitting your order.
7.2. We are not liable for errors in customer-supplied text that were accurately reproduced as submitted. Where we identify an obvious error before production, we will make reasonable efforts to confirm with you before proceeding, but are not obliged to do so.
7.3. Corrections requested after production has begun may incur a reprint fee.
8. Not for Medical, Biometric, or Identification Use
8.1. Our Service is provided for artistic and personal keepsake purposes only. Images are not medical-grade and must not be relied upon for diagnostic, medical, ophthalmological, or health-screening purposes.
8.2. Images are not produced or verified to any standard required for biometric identification, security, government identification, or authentication purposes, and must not be used for any such purpose.
8.3. You accept that any use of your Final Image outside these stated artistic and personal purposes, including any biometric or identification use, is at your own risk and is not something we warrant, endorse, or take responsibility for.
9. Image Usage Rights & Marketing Consent
9.1. Unless you opt out in accordance with clause 9.3, you grant us a non-exclusive, royalty-free right to use images and video captured during your Session (including behind-the-scenes and process footage) for marketing, promotional, portfolio, and social media purposes, in any medium, without further compensation to you.
9.2. We will not use identifiable images of you for marketing purposes in a manner that is misleading or that suggests a medical or biometric endorsement, consistent with clause 8.
9.3. You may opt out of marketing use of your images at any time by telling our staff before or during your Session, or by emailing us afterwards at Hello@IrisPhotographyNZ.com quoting your booking details. At each Pop-Up Event and on our booking page, we will display or state clearly that this opt-out is available, so that you have a genuine, clearly signposted opportunity to decline before your Session takes place.
9.4. Opting out of marketing use does not affect your right to receive your own purchased Final Image.
9.5. Iris Photography NZ and Iris Photography AU are operated under common ownership. Where you have not opted out, marketing images and video from your Session may be used across the marketing, social media, and promotional channels of both businesses, regardless of which country you booked in. This may involve your images and personal information being stored or accessed in Australia (see our Privacy Policy for details).
10. Filming & Behind-the-Scenes Content
10.1. We may film or photograph the general Pop-Up Event environment for promotional purposes. Where reasonably practicable, we will display signage at the event indicating that filming may be taking place.
10.2. If you do not wish to appear in general event footage, please let our staff know on arrival and we will take reasonable steps to avoid or edit out your likeness where practicable.
11. Minors & Group Bookings
11.1. You must be at least 18 years old to enter into this agreement, or have the express consent of a parent or legal guardian.
11.2. A parent or legal guardian must be present, or must have provided express prior consent, for any Session involving a person under 18.
11.3. If you are booking or checking in on behalf of a group, family, or event, you confirm that all individuals in your group (including any minors) agree to these Terms, and that you have the authority to accept these Terms on their behalf.
11.4. Clause 9 (Image Usage Rights) applies equally to images of minors, subject to the consent obtained under this clause 11.
12. Intellectual Property & Copyright
12.1. We retain full copyright and ownership of all Raw Images and Final Images, including the editing, compositing, and design work applied to them, unless otherwise agreed in writing.
12.2. Upon full payment, you receive a personal-use licence to use your Final Image for private, non-commercial purposes, including printing for personal display and sharing on personal social media.
12.3. You may not resell, sublicense, use your Final Image for commercial purposes, or claim copyright ownership of it, without our prior written consent.
12.4. Raw Images are not provided as part of the standard package and remain our property unless a raw file purchase option is separately agreed in writing. Raw Images are typically deleted from our systems within a few months of your Final Image being delivered, except where retained longer for a raw file purchase agreed under this clause, or as otherwise described in our Privacy Policy.
12.5. Any designs, templates, composites, frame styles, or branding created by us remain our intellectual property.
12.6. We do not supply, sell, or license identifiable customer images to third parties for the purpose of training artificial intelligence or machine learning models. Where we use AI tools in our own marketing production (for example, to animate or stylise brand assets), this does not involve submitting identifiable customer iris images to third-party AI systems without your separate consent.
13. Delivery & Turnaround
13.1. Digital images are typically delivered within the timeframe stated at the time of booking or on the Website. Framed and printed products are produced and shipped separately and may take longer, as advised at the time of order.
13.2. Delivery timeframes are estimates only. We are not liable for delays caused by couriers, printing partners, or other third parties outside our reasonable control, though we will assist in resolving delivery issues where we reasonably can.
13.3. Risk in physical products (prints, frames) passes to you on delivery to the address you provided. You are responsible for providing an accurate delivery address.
14. Physical Products & Natural Material Variation
14.1. Framed and printed products are handmade using natural materials (such as wood and glass) and printed using premium print processes. Minor variation in colour, grain, or finish between the digital preview and the final physical product is normal and is not a defect.
14.2. If a physical product arrives damaged in transit or is materially defective, please contact us within 7 days of delivery with photographic evidence, and we will arrange a repair, replacement, or remedy in accordance with clause 15 and your rights under the Consumer Guarantees Act 1993.
15. Cancellations & Refunds
15.1. Because each Session is a bespoke, personalised service and products are made to order, we do not offer refunds for change of mind once a Session has taken place or production has commenced.
15.2. If you need to cancel or reschedule before your Session, please contact us as soon as possible. Rescheduling is subject to availability and is offered at our discretion where reasonable notice is given.
15.3. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy available to you under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand consumer protection legislation that cannot lawfully be excluded. Where our Service fails to meet a guarantee under that legislation, we will provide the remedy required by law.
15.4. Where a remedy under clause 15.3 applies, we will, at our option and as appropriate to the failure, repair, replace, or refund the affected product or service.
16. Payment Disputes & Chargebacks
16.1. If you have a concern about a charge, please contact us first at Hello@IrisPhotographyNZ.com so we can try to resolve it directly and promptly.
16.2. Initiating a chargeback or payment dispute with your bank or card provider without first contacting us does not override clause 15, and does not automatically entitle you to a refund where no consumer guarantee has been breached.
16.3. We reserve the right to dispute chargebacks that we consider unwarranted, and to provide evidence of the Session and delivery to the payment provider in doing so.
17. Privacy & Data Protection
17.1. We collect personal information (such as your name, contact details, and payment confirmation) solely to process your booking, deliver your order, and, where you have not opted out under clause 9.3, for marketing purposes.
17.2. We will not sell or share your personal information with third parties, except: (a) as required by law; (b) with service providers who help us operate our business (such as printing, framing, or delivery partners), who are only permitted to use your information to perform those services; or (c) with your consent.
17.3. We handle personal information in accordance with the Privacy Act 2020 and its Information Privacy Principles. You may request access to, or correction of, your personal information at any time by emailing Hello@IrisPhotographyNZ.com.
17.4. In the unlikely event of a data breach involving your personal information that poses a risk of serious harm, we will notify affected individuals and the Office of the Privacy Commissioner in accordance with our obligations under the Privacy Act 2020.
17.5. Our Website may use cookies to analyse traffic and improve user experience, as described in any cookie banner or Privacy Policy published on the Website.
18. Limitation of Liability
18.1. To the maximum extent permitted by law, and subject to clause 15.3, our total liability to you arising out of or in connection with a Session or these Terms, whether in contract, tort, or otherwise, is limited to the amount you paid for the relevant Session or product.
18.2. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, including loss of enjoyment, loss of data, or emotional distress, arising from your use of our Service, except where such liability cannot lawfully be excluded.
18.3. Nothing in this clause limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded or limited under New Zealand law.
18.4. No term of this clause 18 is intended to be, and none shall be applied or interpreted as, an unfair contract term under the Fair Trading Act 1986. If any term of this clause is held to be an unfair contract term, that term is void to that extent only, and the remainder of these Terms, including the rest of this clause, continues to apply.
19. Indemnity
19.1. You agree to indemnify and hold harmless Iris Photography NZ and its employees, contractors, and agents from any claim, loss, or expense (including reasonable legal costs) arising from: (a) your breach of these Terms; (b) your misuse of a Final Image, including any biometric, medical, or identification use contrary to clause 8; or (c) any misrepresentation you made regarding your authority to accept these Terms on behalf of another person under clause 1.3 or clause 11.3.
19.2. This indemnity does not apply to the extent a claim, loss, or expense arises from our negligence or breach of these Terms.
19.3. This indemnity is limited to losses that are direct and reasonably foreseeable, and does not require you to compensate us for matters that are properly our responsibility under clause 15.3 (Consumer Guarantees). No term of this clause is intended to operate as an unfair contract term under the Fair Trading Act 1986, and clause 18.4 applies equally to this clause 19.
20. Force Majeure
20.1. We are not liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including natural disasters, extreme weather, equipment failure, power outages, illness, venue unavailability, or government restrictions.
20.2. Where a Force Majeure event prevents a booked Session from proceeding, we will offer a rescheduled Session where reasonably possible, or a refund in accordance with clause 15.
21. Dispute Resolution & Governing Law
21.1. If a dispute arises, both parties agree to first attempt to resolve it through good-faith informal negotiation by contacting Hello@IrisPhotographyNZ.com.
21.2. If a dispute cannot be resolved informally within a reasonable period, the parties agree to attempt resolution through mediation before commencing any court proceedings, except where a party seeks urgent interim relief.
21.3. These Terms are governed by the laws of New Zealand. Subject to any consumer protection legislation that provides otherwise, each party submits to the non-exclusive jurisdiction of the New Zealand courts.
21.4. For low-value claims, either party may bring a claim before the New Zealand Disputes Tribunal in accordance with its jurisdictional limits, as a faster and lower-cost alternative to court proceedings. This clause does not limit your right to do so.
22. Amendments to These Terms
22.1. We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The version published on our Website at the time of your booking applies to that booking.
22.2. Material changes affecting an existing, unfulfilled booking will be communicated to affected clients directly where reasonably practicable.
23. Severability & Entire Agreement
23.1. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
23.2. These Terms, together with any Privacy Policy published on our Website, constitute the entire agreement between you and us regarding the Service, and supersede any prior discussions or agreements on the subject.
24. Assignment
24.1. We may assign, novate, or transfer our rights and obligations under these Terms, including in connection with a sale, merger, restructuring, or reorganisation of our business (including a transfer between Iris Photography NZ and Iris Photography AU or any successor entity), without requiring your further consent, provided your rights under these Terms and under New Zealand consumer protection law are not diminished as a result.
24.2. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
25. Third-Party Rights
25.1. Except as expressly stated in these Terms (including in relation to Iris Photography AU), a person who is not a party to these Terms has no right under the Contract and Commercial Law Act 2017 or otherwise to enforce any term of these Terms.
26. Notices & Electronic Communications
26.1. You consent to receiving notices, booking confirmations, receipts, and other communications from us electronically, including by email or text message, to the contact details you provide.
26.2. Any notice you wish to give us under these Terms should be sent to Hello@IrisPhotographyNZ.com. Notices are treated as received when actually read by us, or one business day after sending, whichever is earlier.
27. Interpretation
27.1. Headings are for convenience only and do not affect the interpretation of these Terms.
27.2. A reference to legislation includes that legislation as amended, re-enacted, or replaced from time to time.
27.3. If there is any conflict between these Terms and any specific written agreement we enter into with you, the specific agreement prevails to the extent of the inconsistency.

7.1. If you have not opted out, we may use your contact details and session images for marketing purposes, including on social media and our website, consistent with our Terms and Conditions.
7.2. You can opt out of marketing use of your images or contact details at any time by telling our staff before or during your Session, or by emailing Hello@IrisPhotographyNZ.com. We will action opt-out requests as soon as reasonably possible.
7.3. Any marketing emails we send will include a clear way to unsubscribe.
8. Cookies & Website Analytics
8.1. Our website uses cookies and similar technologies to remember your preferences and to analyse website traffic through tools such as Google Analytics.
8.2. You can control or disable cookies through your browser settings. Disabling cookies may affect some website functionality, but will not prevent you from booking a Session by other means.
8.3. Analytics tools we use may store data on servers located overseas (see clause 10).
9. Data Storage & Retention
9.1. We retain personal information, including images, for as long as reasonably necessary to fulfil the purposes described in this Policy, including:
9.2. You may ask us to delete your personal information or images at any time by emailing Hello@IrisPhotographyNZ.com, and we will do so unless we are legally required to retain it (for example, financial records) or have another legitimate reason to keep it, in which case we will let you know.
9.3. Where a marketing image or video has already been published (for example, on social media or in a completed campaign), we will remove it from future use on request, but may not be able to retrieve copies already shared, cached, or reposted by third parties.
10. Overseas Disclosure
10.1. Some of the third-party service providers we use (such as payment processors and analytics tools) may store or process information on servers located outside New Zealand, including in the United States or other jurisdictions.
10.2. Because Iris Photography NZ and Iris Photography AU are operated under common ownership, marketing images, video, and related personal information may also be transferred to, stored in, and used by Iris Photography AU in Australia, as described in clause 6. This is a disclosure of personal information outside New Zealand for the purposes of Information Privacy Principle 12.
10.3. Where we disclose personal information to an overseas recipient, including Iris Photography AU or our overseas service providers, we take reasonable steps to ensure it is subject to privacy protections comparable to the Privacy Act 2020. Personal information used or held by Iris Photography AU in connection with its own Australian operations may also be subject to the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
11. Your Rights
11.1. Under the Privacy Act 2020, you have the right to:

12.1. We take reasonable technical and organisational steps to protect your personal information from loss, misuse, unauthorised access, or disclosure, including restricting access to personal information to those who need it to perform their role.
12.2. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.
13. Data Breach Notification
13.1. If a privacy breach occurs that has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as required under the Privacy Act 2020, as soon as practicable.
14. Children's Privacy
14.1. We collect personal information about minors only where a parent or legal guardian has provided consent in accordance with our Terms and Conditions.
14.2. A parent or guardian may request access to, correction of, or deletion of a minor's personal information on their behalf, in accordance with clause 11.
15. Changes to This Policy
15.1. We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The current version will always be available on our website.
